Terms of Service

1. Agreement to these Terms
These Terms form a binding agreement between you and Loadcircle Ltd ("we", "us", "our") governing your use of the Itemise application and this website (together, the "Service"). By installing or using Itemise you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
2. What Itemise is, and what it is not
Itemise is a record-keeping tool. It stores the information you enter about your possessions and prints it as a document. It is not an insurer, a broker, a loss adjuster, a valuer or a source of advice.
- Your record, your figures. Every value in Itemise is one you typed in. The app adds up what you entered; it does not estimate, appraise or verify anything, and it has no access to market prices.
- No claim is made by using it. A schedule of loss produced by Itemise is your own record. Whether an insurer accepts it, and what they pay, is between you and them.
- Accuracy is your responsibility. You should record what you actually own and keep the figures up to date.
3. Your record, and keeping it
Everything you enter belongs to you. It is stored only on your device, in the app's private storage, and we never receive a copy (see the Privacy Policy). Two consequences follow, and they matter:
- Keep your own copy. If the device is lost, damaged or reset, your inventory goes with it and we cannot recover it, because we never had it. Export the schedule as a PDF and keep it somewhere you trust, and make your own device backups.
- The Service is provided as-is. We do not guarantee that any record will be preserved.
4. Licence
We grant you a limited, non-exclusive, non-transferable, revocable licence to use Itemise for your own personal or household purposes, on devices you own or control. The app, its design, text and graphics are owned by Loadcircle Ltd or its licensors and are protected by intellectual-property law. You may not resell, sublicense, or redistribute the app, or reverse engineer it except as permitted by law.
5. Acceptable use
You agree not to use Itemise to create, keep or submit any record that is false, inflated, or intended to support a fraudulent claim, and not to use the Service in breach of any applicable law. This is the one thing the app is for, and misusing it in this way is a breach of these Terms.
6. No warranty
To the maximum extent permitted by law, the Service is provided without warranties of any kind, express or implied, including fitness for a particular purpose and non-infringement. We do not warrant that the app will be uninterrupted or error-free, or that any record you keep will be accepted by any insurer or other third party. Nothing in these Terms excludes or limits rights you have as a consumer under applicable law that cannot be excluded, or our liability for death, personal injury, fraud, gross negligence or wilful misconduct.
7. Limitation of liability
To the maximum extent permitted by law, neither party is liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data, even if advised of the possibility; and our total aggregate liability arising out of or relating to the Service is limited to the greater of the amounts you paid us for the Service in the 12 months before the claim arose, or GBP 50. This section does not apply where prohibited by applicable law, including your mandatory consumer rights.
8. Changes to the Service and to these Terms
We may update the app and these Terms. If a change is material and reduces your rights, we will publish the revised Terms here with a new effective date before it takes effect. Continued use after that date constitutes acceptance; if you do not agree, stop using the app and uninstall it.
9. Governing law
These Terms are governed by the laws of England and Wales, without regard to conflict-of-laws rules. Before filing a claim, please contact us at the address below and give us 30 days to resolve it informally. Subject to any non-excludable consumer rights, the courts of England and Wales have exclusive jurisdiction.
